Councilmember <br />moved for its adoption: <br /> <br />introduced the following resolution and <br /> <br />RE~OLUTION %9?-04-__ <br /> <br />HE~OLUTION AUTHORIZING ACQUISITION OF A PERMANENT EA~F~M~NTFOR CITY <br />STREET AND UTILITY PURPOBEB. <br /> <br /> WlIER~AS, the city finds it necessary to construct an extension <br />of Llama Street south of U.S. Highway 10 (the "Street Improvement <br />Project"): and <br /> <br /> I~HEREAS, a permanent easement over, under and across certain <br />real property is required to provide for the construction of the <br />Street Improvement Project and in order to further the public <br />health, safety and convenience of the residents of the city; and <br /> <br /> I <br /> I <br />I' <br /> I <br />I <br />I <br /> <br /> WHEREAS, the City has authority to acquire a permanent <br />easement for the Street Improvement Project by eminent domain <br />pursuant to the City Charter and Minn. Stat. Chapter 117; and <br /> <br />I <br />I <br /> <br /> WHEREAS, the City has the right to acquire the pez~manent <br />easemedlt prior to the filing of an award by the Court appointed <br />commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREAS, the propert~ owner of the real property over which <br />the permanent easement needs to be acquired, upon information and <br />belief, ha~ been identified by the city as follows: <br /> <br /> 29, Township 32, Range 25 ~lng ~d being south <br /> of Trunk: Highway No. 10, for~r~ ~nown ~ U.S. <br /> <br /> NOW THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows; <br /> <br />That the City Administrator is hereby directed to acquire a <br />permanent easement for street and utility purposes over, under <br />and across the real property as described above in accordance <br />with Minnesota Statutes. The city Administrator is authorized <br />to negotiate and represent the City of Ramsey in all <br />proceedings. <br /> <br />That if the permanent easement as described above cannot be <br />acquired by direct negotiation, it shall be acquired by <br />eminent domain. <br /> <br />I <br />I <br /> <br />! <br /> <br />$ <br /> <br /> <br />
