I I I I I I I I I I I I I I I I I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #97-04- RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY MCKINLEY STREET NW AND UTILITY TRUNK LINES TO SERVE THE AEC ENERGY PARK WHEREAS, the City finds it necessary to extend its municipal water and sanitary system to promote the development of the AEC Energy Park; and WHEREAS, new utility infrastructure and public roadways (collectively the "Public Improvement") are necessary to accomplish this requirement; and WHEREAS, the City finds it necessary to acquire fee title to certain real property in order to provide property for the construction of the water and sanitary sewer trunk lines and public roadway; and WHEREAS, the City has the right to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to filing of an award by the Court Appointed Commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: PIN Part of 27-32-25-21-0012 FEE OWNER L. W. Makens REAL PROPERTY DESCRIPTION Lot 1, AUDITOR'S SUBDWISION 31, according to the map or plat thereof on record in the office of the County Recorder in and for Anoka County, Minnesota, except that part lying Southerly and Easterly of the following described line: commencing at a point on the East line of said Lot 1,200 feet South of the Northeast comer thereof; thence South 37 degrees 56 minutes 28 seconds West, a distance of 283.98 feet to the South line of said Lot 1 and there terminating. AND WHEREAS, the property owner has requested the City begin the condemnation proceedings.
