10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />That the Applicant has submitted a site plan and a court detail plan dated received by the <br />City on April 3, 1997. <br /> <br />That Section 9.11.20, Subd. 3, of the City Code requires a 40 foot landscaped separation <br />between residential and non-residential uses. The court detail plan submitted by the <br />Applicant proposes to maintain a 40 foot separation between the volleyball courts and the <br />adjacent parcel to the south in the event that parcel is rezoned to single family residential. <br /> <br />That Section 9.11.20, Subd. 4 of the City Code also requires screening between <br />commercial and residential uses. The Applicant is proposing to install chain link fence <br />along the common property line with the adjacent parcel to the southwest w/thout <br />disturbing the existing, substantial tree growth along that tine in the event the adjacent <br />parcel is rezoned to single family residential. <br /> <br />That the parcels on the west side of Ebony Street N.W. are zoned B-3 Highway Business <br />and Section 9.11.20, Subd. 3, does not require screening when the parcels across the <br />street are zoned commercial. However, Section 9.11.09 of the City Code requires a 20 <br />foot wide landscaped area along all streets; therefore, landscaping is required adjacent to <br />Ebony Street N.W. The court detail plan submitted by the Applicant proposes to <br />establish trees along Ebony Street but the width of this yard area is not noted on the plan. <br /> <br />That the Applicant has stated that the development of the volleybalI courts is not reducing <br />the amount of paved, off-street parking spaces that currently exist on the subject property. <br /> <br />That the proposed use will not be unduly dangerous or detrimental to persons <br />residing or working in the vicinity of the use, or to the public welfare. <br /> <br />That the proposed use wilt not substantially adversely impair the use, enjoyment or <br />market value of any surrounding property. <br /> <br />That the proposed use will be designed, constructed, operated, and maintained so as to be <br />harmonious and appropriate in appearance with the existing or intended character of the <br />general vicinity and will not change the essential character of the area. <br /> <br />That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />That the proposed use will be a substantial improvement to the property. <br /> <br />That the proposed use will be served adequately by essential public facilities and <br />services, such as highways, streets, police and fire protection. <br /> <br />That the proposed use will not create excessive additional requirements at public cost <br />for public facilities and services and will not be detrimental to the economic welfare <br />of the community. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />! <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br /> <br /> <br />
