The CITY has enacted a Development Assessment in the <br />amount of Five Hundred Dollars ($500.00) per lot. The amount of the assessment due on <br />the Plat is Nineteen Thousand Dollars ($19,000.00). The DEVELOPER has the option to <br />either: (a) pay the entire amount due prior to the CITY releasing the Plat for recording at <br />the County; or (b) pay fifty percent of the assessment ($9,500.00) prior to the CITY <br />releasing the Plat for recording and divert the remaining $9,500.00 due as an additional <br />$250.00 fee on each building permit issued in the Plat. The amount of the <br />DEVELOPER'S share of the assessment shall be utilized for future signalization at the <br />intersection of 153rd Avenue NW and County Road #57. <br /> <br />III. PERMITS AND OCCUPANCY · <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat shall <br />be issued until: (a) vehicular access to the lot is provided including the installation'of Class <br />V material on all streets in the Plat; (b) site plan approval is granted by the CITY and any <br />additional expense incurred in giving site plan approval has been reimbursed to the CITY; <br />(c) a Certificate of Survey, including that information required by the CITY, has been <br />supplied to the City Building Official; (d) a tree planting has been accomplished in <br />accordance with # 16 of this Agreement; and (e) all the financial guarantees required by the <br />CITY have been satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Cash. The Plat is located in the Nature View Park District. Park dedication requirements <br />shall be satisfied by a cash payment in the amount of $33,250.00 (38 units x $875.00 per <br />unit). Said payment has been received by the City pursuant to the terms of the January <br />, 1997 purchase agreement between the CITY as Seller and DEVELOPER as Buyer for <br />the sale of the Subject Property. <br /> <br />V. LANDSCAPING <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the Plat <br />prior to issuance of a Certificate of Occupancy. In accordance with the City Code and the <br />policy established by the City of Rarnsey Park and Recreation Commission on June 10,. <br />1993, the DEVELOPER is required to submit a Landscape Plan for CITY approval that <br />identifies existing tree growth within the Plat that will be preserved during construction <br />and new plantings.
