6 <br /> <br />purchase price received by Developer upon the original conveyance <br />thereof by Developer (net of the unpaid principal balance of any <br />seller financing given by Developer. Upon written request, <br />Developer may, but shall be under no obligation to, execute and <br />furnish a written statement in recordable form indicating that the <br />reacquisition option in favor of Developer described in this <br />paragraph 2°8 has been waived by Developer. <br /> <br /> 2.8a E×teriors. All fronts of dwellings or garages must be <br /> a 42" minimum from brick wainscot or 20% of front elevation <br /> exclusive of windows and doors, whichever 'is greater, <br /> exclusive of garage. No board and batten, and no lap siding <br /> shall exceed a six inch (6-inch) reveal. <br /> <br />Ail roof shingles shall be 235~ per square minimum, or of a <br />material approved by the ARC. Roof pitch shall be no less <br />than 6-12. <br /> <br />Ail ~xterior colors shall be earth tones or such equivalent <br />colors as may be approved by the Architectural Review <br />Committee. ~ <br /> <br />2.9 Setbacks. Minimum setbacks shall be as follows:'~ <br /> <br />(a) Front setback: thirty-five (35) feet from any <br />front lot line with respect to improvements of any <br />nature on a Lot (other than driveways); <br /> <br />(b) .Rear setback: thirty-five (35f ~eet from any rear <br />lot line with respect to improvements of any nature on <br />a Lot; ~ <br /> <br />(c) Side setback: ten (10) fee~ from any interior lot <br />line; provided, however, that (i) single-story garages <br />may be constructed within five (5) feet of any interior <br />lot line; and (ii) in the event a two-story Residence <br />is to be constructed on a Lot which is adjacent to a <br />Lot which contains an existing two-story Residence, and <br />the two story portion of each such Residence will be <br />the portion of such Residence to be constructed shall <br />be twenty-five (25) feet from such existing Residence. <br /> <br />Not withstanding the foregoing (i) all such setbacks from <br />road right-of-way shall be a minimum of fifty (50) feet; and <br />(ii) the Architectural Review Committee may, in its sole <br />discretion, permit exceptions from the requirements <br />described in this paragraph 9 in order to promote and <br />maintain a first class residential development within the <br />Subject Property.
