City personnel or agents performing the inspection will notify <br />personnel at the landfill office at the time of inspection. <br /> <br />Indemni .ty~ WMMt shall indemnify, defend and hold the City hanrdess from all claims, <br />demands and/or actions legal and/or equitable arising from the operations. Upon <br />commencement of this CUP, WM2vlI shall deliver to the City an executed <br />indemnification agreement in the form of Exhibit A attached hereto. <br /> <br />Documents and Maps. Copies of all test results, pertinent correspondence from the <br />Permit Holder and to the Permit Holder from regulatory agencies, and all documents, <br />reports and plans wkich are required to be supplied to the MPCA, Anoka County or other <br />governmental agencies shall also be supplied concurrently to the City at no cost to the <br />City. <br /> <br />~ The Permit Holder shall maintain a 75% opacity screening to a height of 20' <br />from a base elevation of 870'. <br /> <br />Odor, Noise. N. ujsance Control. The Permit Holder shall comply with the performance <br />standards of the City Code, state and federal regulations as may be amended or revised <br />over the term of this Permit. <br /> <br />Discharge to Ci.ty Storm Sewer. The Permit Holder is the sole responsible party <br />responsible for NPDES Permit MN 0060259. All recovered water shall meet all <br />applicable federal and state water quality standards prior to discharge into the City storm <br />sewer for non-degradation requirements, recommended allowable limits, and chronic <br />toxicity criteria. The Permit Holder shall provide quarterly monitoring reports in <br />conjunction with the NPDES monitoring reports which verify compliance of the effluent <br />at a point prior to discharge to the City's storm sewer system. <br /> <br />Monitoring Reports. Monitoring reports must include a summary evaluation about the <br />effectiveness of the system during the monitoring period, trend analYsis of the water <br />monitoring records at influent and effluent points, groundwater level data as well as any <br />proposed activities. <br /> <br />_Water QualiW.Sample~ .mud Testing. Once each year, if requested, split samples shall be <br />taken of both influent and effluent and sent to an independent testing laboratory for <br />evaluation. The evaluation shall consist of the same parameters as those required in the <br />NPDES permit for effluent characteristics and as identified in the RAP. The testing lab <br />shall be mutually agreed upon by the City and the Permit Holder. The lab shall prepare a <br />report and submit a signed copy to both the Permit Holder and the City. The costs of the <br />sampling and testing program, subsequent evaluation, and reports shall be borne by the <br />Permit Holder.
