That the recitals above and the provisions of the City <br />Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as <br />amended to date hereof, are incorporated herein by reference. <br /> <br />Property_ Deeds. The DEVELOPERS herein agree to deed Outlots A and B to the <br />CITY in a separate recordable document. The CITY shall not execute deeds for the <br />transfer of property to the DEVELOPERS until DEVELOPER A provides the <br />following or a financial surety for same, in a form acceptable to the CITY. <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />berming necessary to redirect drainage away from Outlot A; <br />fencing along the common property line between Outlot A and Lot 2 to prevent <br />any future encroachment of commercial activities onto said Outlot; <br />removal of all debris property conveyed to Outlot A. <br /> <br />("Requirements") <br /> <br />DEVELOPER A shall have one year from the date the Plat is recorded to complete the <br />above Requirements. In the event DEVELOPER A fails to complete the above as <br />required herein, the CITY shall provide notice to DEVELOPER A of the default <br />condition and establish a thirty (30) day time frame in which to remedy the default <br />condition. If DEVELOPER A fails to do so within the 30 day time frame, the City <br />Council may order the completion of the Requirements with City day labor and/or by <br />letting contracts for said completion and draw upon the financial surety for payment. <br />Only the City Council shall have the authority to direct completion of the Requirements <br />and withdraw from the financial surety account. DEVELOPER A hereby grants <br />permission and a license to the City and/or its contractors and assigns to enter upon the <br />Site for the purpose of cOmpleting the above the Requirements in the event of <br />DEVELOPER A's default. <br /> <br />License for Access. Upon request, the CITY herein agrees to provide DEVELOPER A <br />and/or DEVELOPER B with a license to utilize Outlot B as an access to Unity Street <br />N.W. Further, it is agreed that if the license for access is exercised prior to installation of <br />public street improvements on Outlot B, the recipient(s) of the license shall provide for a <br />bituminous or concrete access drive across Outlot B. Said license shall not prohibit or <br />obstruct in any manner the CITY'S ability and/or authority to construct a public street to <br />specified standards across Outlot B <br /> <br />Covenant~, The south 135 feet of Lot 1, Block 1 and the south 135 feet of Lot 2, Block 1 <br />originated in Business Park 95 and shall remain subject to the covenants of Business Park <br />95 which was recorded at Anoka County on . ._, 1995 as Document <br /> <br /> <br />
