3) Lease Property Management <br />City Administrator Ulrich summarized staff's report. <br />Councilmember McGlone recommended the agreement be terminated and that the tenant be <br />responsible for general maintenance with a renegotiated lease. <br />City Attorney Goodrich responded he would need to review the agreement . to see if general <br />maintenance could be added. <br />It was Council's consensus to terminate the agreement. <br />4) Consider Acquisition of Necessary Right -of -Way for the Potential Future Extension <br />of Variolite Street <br />City Engineer Himmer summarized staff's report. <br />The Council discussed the MSA and the Comprehensive Plan. <br />Councilmember McGlone recommended starting the process over again and looking at the east <br />alignment to start the funding process and to start purchasing land from willing sellers. <br />Mayor Ramsey agreed the property would be needed in the future. <br />Senator Jungbauer noted this would affect the resident's property values if a line was drawn by <br />the City noting a future road would come through. <br />City Attorney Goodrich stated he did not agree with this and this was not a taking, but rather <br />planning for the future. <br />Mayor Ramsey believed there was only one option for the road, which was the recommendation <br />Public Works made. <br />Public Works Director Olson stated the direction from Council was to align the road with the <br />CIP, which at this time did not impact the resident's property. <br />The residents on Variolite requested a letter from the City that the road was not proposed to go <br />through their property and indemnification. <br />Mayor Ramsey requested them to contact the City Administrator who would consult with the <br />City Attorney as to what the City could do in terms of a letter. <br />The City Attorney noted the City could not indemnify them. <br />City Council Work Session / December 7, 2010 <br />Page 2 of 3 <br />
