CASE # OOt ADOPT FINDINGS OF FACT TO SUPPORT DENIAL OF REQUEST FOR REZONING; CASE OF GOOD VALUE HOMES AND ROBERT MAXTON By: Zoning Administrator Sylvia Frolik Background: Robert Maxton, foe title owner, and John Peterson of Good Value Homes requested a rezoning of property located north of 153rd Avenue N.W. and west of T.H. #47 from commercial to residential to facilitate the development of single family homes on the site. Notification: State statute requires notification of the public hearing to owners of property within 350 feet of the subject property. Staff notified property owners within 700 feet of the subject property of the public hearing conducted by the Planning Commission on April 1, 1997. Observations: On April 1, 1997, the Planning Commission conducted the public hearing and recessed until April 7. On April 7, the Planning Commission recommended approval of the request for rezoning. On April 22, 1997, the City Council adopted findings of fact #97-04-080, of a positive nature, relating to the rezoning application and introduced an ordinance by a 3 to 2 vote to rezone the property to residential. On May 27, the second reading of the ordinance failed by a 3 to 2 vote (4/5 required). Staff was directed to draft a resolution for Council consideration that would establish a negative findings based on Council's discussions of the application. The site location map and proposed resolution for negative findings are enclosed.
