CASE # OOt <br /> <br />ADOPT FINDINGS OF FACT TO SUPPORT DENIAL OF REQUEST FOR <br />REZONING; CASE OF GOOD VALUE HOMES AND ROBERT MAXTON <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Robert Maxton, foe title owner, and John Peterson of Good Value Homes requested a rezoning of <br />property located north of 153rd Avenue N.W. and west of T.H. #47 from commercial to <br />residential to facilitate the development of single family homes on the site. <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff notified property owners within 700 feet of the subject property of the <br />public hearing conducted by the Planning Commission on April 1, 1997. <br /> <br />Observations: <br /> <br />On April 1, 1997, the Planning Commission conducted the public hearing and recessed until <br />April 7. On April 7, the Planning Commission recommended approval of the request for <br />rezoning. On April 22, 1997, the City Council adopted findings of fact #97-04-080, of a positive <br />nature, relating to the rezoning application and introduced an ordinance by a 3 to 2 vote to rezone <br />the property to residential. On May 27, the second reading of the ordinance failed by a 3 to 2 <br />vote (4/5 required). Staff was directed to draft a resolution for Council consideration that would <br />establish a negative findings based on Council's discussions of the application. <br /> <br />The site location map and proposed resolution for negative findings are enclosed. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the proposed resolution to rescind #97-04-080 and adopt <br />negative findings relating to the request for rezoning. . <br /> <br /> rescind Resolution #97-04-080 and adopt revised <br /> findings of fact ~.~.~')'elating to a request for rezoning from Robert Maxton and Good <br /> Value Homes. <br /> <br />Reviewed by: ,~/¢ <br /> <br />Council Action: <br />Motion to: i[~ <br />Adopt Resolution #97-06- to <br /> <br />CC: 06/10/97 <br /> <br /> <br />
