City of Ramsey <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> Douglas and Julie Hill have lived in the same property for about 13 years. They <br />leased it for the first year and then purchased it. The property is in the City of Ramsey. <br />It is four acres in size and it is zoned commercial. The property is on Highway 10 and has <br />600 feet of frontage on Highway 10. <br /> <br /> While normally cities do not permit residences in commercial zones, the Hills are <br />permitted to live on or next to commercial property (or to have commercial property on or <br />next to a residence) because their r/ghts are "grandfathered". <br /> <br /> Apparently, there is no question presented about the Iawfizlness of the various uses <br />of the property being made. <br /> <br /> The property is being used for a automobile sales lot..There are two lots, each <br />leased to tenants. One of the leases is up for renewal. The ten;mt has been there about <br />three years. The city has insisted that the owners of lots along Highway 10 do two things: <br /> <br />1. Provide curb and gutter along the road frontage; and <br /> <br />2. Provide asphalt blacktopping over the entire commercial portion of the lot. <br /> <br />The tenant has refused to do these things. The Hills do not want to sign the lease if there <br />is a requirement for blacktopping and/or curb and guttering if the tenant is unwilling to do <br />the work ~- or at least they would think twice about it. <br /> <br /> The city is being uncooperative in explaining the Hills' rights to them. It may well <br />be that the curb and guttering requirement is not lawful because Highway 10 is a State <br />highway and the city has no jurisdiction over it. That was exactly the position of Bill <br />Warden (Warner?) in the Metro Division of Engineering. Because there is 600 feet on <br />Highway 10, this is a substantial expense. <br /> <br />The Hills' goals are as follows: <br /> <br /> I <br /> I <br />I <br />I <br />I <br /> <br />I' <br />I <br />I <br />I <br />I <br /> <br /> <br />
