I I I I I I I I I I I ! I I I I I I § 8..80 Administrator shall cause the cleanup assessment to be levied against the property on which the system is located. Subd. 2. Liability. The pl-rnbing inspector or any employee charged with the enforcement of this Chapter of the City, acting in good faith and without malice for the &ischarge of his duties, shall not thereby render himself liable personal]y, and he is hereby relieved from ail personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or ornlssion in the discharge of his duties. Any suit brought against the pl-rnbing inspector or employee because of such act or omission performed by him in the enforcement of any provision of this chapter shall be defined by the legal department of the City of Ramsey until final termination of the proceedings. Sub& ~ Cooperation Of Other Officinls. The plumbing inspector authority may request, and shall receive so far as may be necessary in the discharge of his duties, the assistance and cooperation of the other officials of the City of l~rn~ey. Sub& 4. Appeals. Appeals from the plumbing i~Lspector's decision and requests for variances as to any provisions of this chapter may be made to the l~rnsey City Council. The City Council may grant a variance to 'the strict terms or requirements of this chapter as it affects specific tracts of land if it finds: a. It is shown by reason of topography or other physical conditions that strict compliance with the chapter's requirements could cause an exceptional and undue hardship to the enjoyment of a substantial property right; b. By the granting of the variance, the spirit and intent of the chapter wi]] not be adversely ~fTected; c. That the variance will not be injurious to the health and/or general welfare of: 1. the users of the system for which the variance is sought, 2. the adjacent property owners, and 3. the general community as a whole; d. That the establishment, maintenance or operation of the system as permitted by the variance will not be detrimental to or endanger the public health, safety or general welfare and is not contrary to established standards, regulations or ordinances o£ other gove~rnental agencies. ~L~orical Note Established by Ord. 73-11, August 20, 1973.
