Motion by Councilmember Beahen and seconded by Councilmember Beyer to adopt Resolution <br />#97-05-136 adopting Findings of Fact #0429 relating to Waste Management of Minnesota, Inc.'s <br />request for a conditional use permit to operate a groundwater pump-out and treatment system. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Beyer, Haas Steffen and <br />Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt <br />Resolution #97-05-137 declaring conditions of the conditional use permit for WMMI's <br />Groundwater Pump-Out and Treatment System. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Zimmerman, Beyer, and <br />Haas Steffen. Voting No' None. <br /> <br />Case #17: Implement of Chapter 8 of the Charter <br /> <br />City Administrator Schroeder stated that Council introduced this ordinance on April 22, I997, <br />and tabled the adoption of it in that all five Councilmembers were not present. Adoption would <br />implement the broad language of Chapter 8 of the Charter. It provides a definition for operable <br />wells and septic systems. <br /> <br />City Attorney Goodrich stated that the number one issue is the "due on sale" provision and that <br />was not an issue with the homeowners present at the meeting where the ordinance was <br />introduced. <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard NW, Ramsey, stated, as author of the amendment, <br />this is not what he had in mind. He felt that including the due on sale clause goes against what <br />2,000 citizens voted for. <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br />I, <br /> Ii <br /> <br />I. <br />I <br />I <br /> <br />Councilmember Haas Steffen asked about the other 14,000 residents in Ramsey and added that <br />the City cannot afford for this type of thing to happen often. She stated she would not vote a <br />project in now that did not have 100% of the affected parties voting in favor of it. _Tkis law was <br />made by about 16% of the total people in Ramsey and it affects everyone in Ramsey as they are <br />the ones who ultimately have to pay for the extensions for the people who decline to hook up. <br /> <br />I <br />I <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Beyer to remove section 4.70.05 Sale <br />of Property from the ordinance. <br /> <br />I <br /> <br />Further discussion: Councilmember Beyer stated that the City has not gotten involved in the <br />pay-off of assessments - that has always been left up to the lending institutions. Councilmember <br />Haas Steffen cautioned that there are buyers who do not have attorneys. There should be <br />straight-forward language in this ordinance and no assumption that it will be taken care of by <br />Realtors. The City's Attorney has said tkis is the interpretation he feels is reasonable. Rick <br />Christian, 7330 - 155th avenue NW, stated he would like the option of telling his buyers, when <br />he decides to sell his house, that they never have to hook up to City utilities if they don't want to. <br />Chris Dempsey, 14794 IG-ypton Street NW, stated that when there is reference to a pending <br /> <br />City Council/May 27, 1997 <br /> Page 16 of 22 <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
