I <br /> I <br /> I <br /> I <br /> <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />REQUEST FOR EXTENSION TO REQUIRED IMPROVEMENTS; <br />CASE OF DOUG AND JULIEANN HILLS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, on May 27, 1997, the City Council accepted the City Attorney's opinion that <br />the City does have the authority to place a sunset date on non-conforming or grandfathered <br />performance standards (pavement and curbing) in the commercial zones. As a follow up to that, <br />Doug and Julieann Hills are requesting an extension to the October 1, 1997 deadline for <br />installing required site improvements. <br /> <br />Observations: <br /> <br />On May 27, 1997, the City Council raised the question of how many sites are operating without <br />paved and curbed maneuvering areas and are they in or out of the Metropolitan Urban Service <br />Area (MUSA). In the B-l, B-2 and Bo3 business districts, there are 7 sites that have no <br />pavement or curbing, 4 of which are in the MUSA (see Exhibit A). There are many more sites <br />along the Hwy. #10 corridor that are either deficient in the amount of paving and curbing or the <br />existing pavement is in a very deteriorated condition. <br /> <br />On June 18, City Staff had a preliminary meeting with Mark Koegler of Hoisington Koegler <br />Group in preparation for a follow up meeting to develop the Comprhensive Plan work plan. In <br />that meeting, the Highway #10 corridor was discussed with respect to uses and performance <br />standards. Mr. Koegler indicated that the scope of the comprehensive plan amendment would <br />include a discussion of that corridor. <br /> <br />Recommendation: <br /> <br />City Staff is of the opinion that forcing the investment in site improvements at this time may be <br />untimely depending on the outcome of the comprehensive plan amendment with respect to the <br />Highway #10 corridor. Allowing time to achieve an adopted plan amendment and some <br />additional time for any implementation to occur, City Staff is recommending that the matter of <br />required site improvements in the commercial districts be postponed until Council approval of <br />the 1998 Comprehensive Plan. <br /> <br />Council Action: <br /> <br />Motion to: <br />Authorize City Staff to postpone any further enforcement of the sunset clause on <br />required site improvements in the commercial districts until May 1, 1999. <br /> <br />Review Checklist: <br />City Administrator <br />CC: 6/24/97 <br /> <br /> <br />
