Councilmember Beyer inlroduced the following resolution and moved for its adoption: RESOLUTION ~94-05-i05 RESOLUTION ESTABLISHING LAWFUL GAMBLING CONTRIBUTION PERCENTAGE AS DEFINED IN RAMSEY CITY CODE CHAPTER 7, SECTION 7.61.09 ENTITLED USE OF LAWFUL GAMBLING NET PROFITS WHEREAS, MS Chapter 349.16, Subd 4 and 349.213, Subd. l(a) allow a statutory or home rule charter city to require an organization conducting lawful gambling within its jurisdiction to make an expenditure to the city, as a condition to operate within the city, provided that there exists an ordinance requkement that such organizations must contribute a pementage, not to exceed ten percent (10%), of net profits derived from lawful gambling to a fund administered and regulated by the City without cost to such fund; and WHEREAS, the City of Ramsey currently has in place Ordinance ta)4-05 which specifies the requirements as outlined in MS Chapter 349; and WHEREAS, Ordinance tK94-05 states that the contribution rate will be established from time to time by Council resolution; and WHEREAS, it has been determined that three percent (3%) of net profits derived from lawful gambling shall be the percentage that organizations will be required to contribute to a fund administered and regulated by the City without cost to such fund. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNT, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby establishes three percent (3%) of net profits derived from lawful gambling shall be the percentage that organizations will be required to contribute to a fund administered and regulated by the City without cost to such fund. 2) That the effective date of such contribution requirement would be July 1, 1994 for all lawful gambling activity conducted in the City. 3) That the Finance Officer is hereby authorized to enforce the contribution requirement and ail other areas of Ordinance ~q94-05 which administers and regulates lawful gambling activities in the City. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember. Zimmerman upon vote being taken thereon, the following voted in favor thereof: Mayor Gilbertson Councilmember Beyer Councilmember Zimmerman Councilmember Hardin Councilmember Peterson and the following voted against the same: None I I I I I I I I I I I I I I I I I I i
