CASE <br /> <br />INTRODUCE RIGHT-OF-WAY ORDINANCE <br />By: Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />A year and a half ago, staff originally approached Council regarding passage of a Right of <br />Way Ordinance. Just prior to this time, regulation of municipal rights of way had become <br />an issue when a telecommunications firm took a Minnesota city to court over that city's <br />attempt to regulate its rights of way. At the time of our initial discussion, Council <br />requested that staff bring the issue back upon further study. <br /> <br />Since that time, the courts have made findings and legislation has passed impacting the <br />issue. As a result, both the League of Minnesota Cities and the Quad Cities Cable <br />Commission law firm have revised model ordinances (to comply with new law). The <br />QCTV law firm of Bemick and Lifson has prepared the draft contained in your agenda. <br />They have also prepared the memorandum comparing their draft to that of the LMC. <br /> <br />The City of Ramsey cable commissioners are Councilmember Beahen and Ramsey <br />resident Ken Peterson. Mr. Peterson is intending to be at the Council meeting to answer <br />any questions you may have regarding the ordinance draft. It should be noted that <br />Attorney Goodrich is out of town until July 7, and may not have had an opportunity to <br />review the draf~ ordinance in any detail. That being the case, it would be expected that, if <br />the ordinance is introduced, Mr. Goodrich will be prepared with any suggested changes <br />prior to final adoption.
