I <br />I <br />I <br />I <br />I <br /> <br />6 $ <br /> <br /> FINDINGS OF FACT AND CONCLUSION <br /> REGARDIN~ <br /> DETERMINATION ON NEED FOR THE <br /> PREPARATION OF AN ENVIRONMENTAL <br />ASSESSMENT WORKSHEET FOR THE APPLE RIDGE DEVELOPMENT <br /> <br />That on June 24, 1997 the city received a citizen petition <br />(the "Petition") for an Environmental Assessment Worksheet <br />("EAW") for the proposed subdivision of Apple Ridge which <br />property is legally described in the Petition as follows: <br /> <br />The South Half of the Southeast Quarter of <br />Section 14, Township 32, Range 25, Anoka <br />County, Minnesota, lying west of the west <br />right-of-way line of State Highway No. 47 and <br />Lot 2, Block 1, inclusive J.P.J.V. ADDITION, a <br />plat of record, Anoka County, Minnesota. <br /> <br />( "Proposed Subdivision") <br /> <br />That pursuant to a letter from the Environmental Quality Board <br />("EQB") dated June 24, 1994, the City has been designated as <br />the Responsible Governmental Unit ("RGU"). <br /> <br />That the Proposed Subdivision is a residential subdivision of <br />127 single family homes (the "Project") and is therefore lower <br />than the threshold for the mandatory preparation of an EAW <br />(250 unattached units per Minn. Rules §4410.4300, subp. (4)). <br /> <br />That the Project exceeds the number of units which would <br />automatically be exempt from an EAW. (80 unattached units per <br />Minn. Rules §4410.4600, subp. 12.19 (4). <br /> <br />That the Project falls within a discretionary EAW category <br />that grants to the City discretion to determine that because <br />of the nature or location of a proposed project, the project <br />may have the potential for significant environmental effects. <br /> <br />That the Petition requests the preparation of an EAW and <br />states that the potential environmental effects which may <br />result from the Project are: <br /> <br />"Potential for significant environmental impacts of this type of high density <br />development." <br /> <br />"... there is evidence of oak wilt on the property and by cuttings (sic) and <br />clearing this area there is a real risk of oak wilt spreading to existing healthy oaks <br />both on the site and neighbors' property bordering the proposed development." <br /> <br /> <br />
