The City used the entire lot crossed by the easement for the basis of the <br />distance for the notification, <br /> <br />Background: <br /> <br />The City has completed the construction of the portion of Sunwood Drive Northwest between <br />County Road #57 (Sunfish Lake Boulevard Northwest) and County Road #5 (Nowthen <br />Boulevard Northwest). With the completion of the construction of this section of roadway, the <br />City is required to vacate the existing Old Town Road easement. As you are aware, the City is <br />required to conduct a public hearing and enact an ordinance for the vacation of dedicated street <br />right-of-ways and the sale of publicly owned property. <br /> <br />The legal description of the proposed street right-of-way vacation: <br /> <br />That part of the Town Road as described in Book 60 of Deeds, page 86 which lies within <br />Government Lot 3, Section 26, Township 32, Range 25 Anoka County, Minnesota and <br />lies easterly of the easterly line of Anoka County Right of Way Plat No. 1, according to <br />the recorded plat thereof. EXCEPT any portion of said Town Road lying within the <br />right-of-way of Sunwood Drive Northwest as described in document No. 1226775. <br /> <br />Enclosed for your review is the following information: <br /> <br />1. Public hearing notice <br />2. Site location map <br />3. Properties notified list <br />4. Proposed ordinance vacating street right-of-way <br /> <br />If this proposed ordinance is adopted, the City will request that Anoka County change the City <br />map to reflect the vacation. The City will also be recording the vacation at Anoka County to <br />prevent future title problems for the property owners. <br /> <br />Recommendation: <br /> <br />The City Staff recommends vacation of the street right-of-way of the Old Town Road as required <br />under the agreement for the right-of-way acquisition for Sunwood Drive Northwest. <br /> <br />//t <br /> <br /> <br />
