Mr. Kurak stated he agrees with this condition. <br /> <br />At the request of the audience, Zoning Administrator Frolik read each condition of the permit under <br />consideration. <br /> <br />Acting Chairperson Deemer asked if Term No. 7 incorporates the entire 39 acres and suggested it <br />be modified to exempt equipment located on the homestead. <br /> <br />City Engineer Jankowski suggested the condition except personal property. The Planning <br />Commission agreed and directed that the following words be included at the end of the last sentence <br />"excepting personal property." <br /> <br />City Engineer Jankowski advised that Term No. 9 may not be required since City Code indicates a <br />maximum amount of reforestation. Zoning Administrator Frolik stated this could be modified, if <br />needed, prior to Council consideration. <br /> <br />Acting Chairperson Deemer inquired regarding the type of fencing to be required in Term No. 12. <br />City Engineer Jankowski stated it is the standard construction fencing, not cyclone fencing. Mr. <br />Kurak stated he will use nice fencing, not orange construction fence, to block the public from driving <br />into the area. <br /> <br />Discussion occurred regarding the one day requirement and financial burden it will cause in having <br />to restore the site every Friday. <br /> <br />Motion by Acting Chairperson Deemer and seconded by Commissioner Terry, amend Term No. 14 <br />to increase the interval to two days. <br /> <br />Motion carded. Voting Yes: Acting Chairperson Deemer, Commissioners Terry, La,Due, and <br />Thorud. Voting No: None. Absent: Chairman Bawden, Commissioners Jensen and Holland. <br /> <br />Action Chairperson Deemer advised of the minor procedure for the applicant to request, the right to <br />work on a Saturday and informed the audience that notice is not sent to adjoining property owners. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry to recommend that City <br />Council approve Tom Kurak's request for a conditional use permit to grade and export soils. <br /> <br />Motion carried. Voting Yes: Acting Chairperson Deemer; Commissioners LaDue, Terry and <br />Thorud. Voting No: None.
