Councilmember introduced the following resolution and moved for its adoption: PROPOSED RESOLUTION #97-08- '~ (~) A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR A TEMPORARY STRUCTURE AND DECLARING TERMS OF SAME VOtEREAS, Amcor Precast, tradename of Oldcastle Precast, Inc. has properly applied for an interim use permit for a temporary structure for the purposes of providing additional office space on the property generally known as 6640 Industry Avenue N.W. and legally described as follows: The East Half of the Southeast Quarter of the Southwest Quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota, except that part thereof described as follows: Commencing at the Northwest comer of said East Half of the Southeast Quarter of the Southwest Quarter; thence South along the West line of the said East Half of the Southeast Quarter of the Southwest Quarter 409.44 feet to the point of beginning; thence East at right angles 11 feet; thence South at right angles 264 feet; thence West at right angles to the West line of said East Half of the Southeast Quarter of the Southwest Quarter; thence North along said West line to the point of beginning. (" Subject Property") WltEREAS, the Planning Commission met on August 5,. 1997, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , an interim use permit for continued use of the 24' x 60' modular office structure is hereby granted to Amcor Precast, hereinafter referred to as "Permit Holder", at 6640 Industry Avenue N.W.: 2. This permit shall terminate on June 1, 1999. 3. The temporary structure shall comply with all applicable Building Code and Fire Code regulations and standards for such structures. o The Permit holder shall be responsible for all City costs incurred in administering and enforcing this interim use permit. Said expenses shall be paid within 15 days of billing by the City and failure to pay the City's expenses within the 15 day billing period will permit the City to draw upon any of the escrows required by this agreement for payment. Furthermore, to ensure the timely removal of the temporary structure prior to the expiration date of this permit, the Permit Holder shall maintain a minimum balance of $500.00 in the application escrow account until such time as the permit has expired and/or the temporary structure has been removed from the property.
