CASE <br /> <br />ADOPT ORDINANCE VACATING DRAINAGE & UTILITY EASEMENTS <br />ALONG THE BORDERS OF LOT 1, BLOCK 2~ AND OUTLOT Cz OF RUM <br />RIVER HILLS ADDITION <br /> By: James Gromberg, Economic Development Coordinator <br /> <br />Background: <br /> <br />The developer of the Rum River Hills Townhomes has requested that the City vacate the <br />drainage and utility easements that were dedicated at the time the subdivision was <br />completed. These drainage and utility easements are the traditional 10-foot wide <br />easements that are acquired during the platting process. The developer intends to <br />rededicate new easements at the time that the replatting is completed. <br /> <br />The developer has completed and recorded the Rum River Hills Townhome plat and <br />dedicated the required drainage and utility easements. Unfortunately, this ordinance <br />completing the vacation was not completed as intended with the recording of the plat. <br />Since a public hearing was conducted in December 1994, and the plat has been recorded, <br />the City Council should adopt the ordinance and provide for the completion of the <br />vacation. Enclosed for your review is the following information: <br /> <br />Public hearing notice <br />Minutes from public heating <br />Site location map <br />List of properties notified <br />Proposed ordinance vacating drainage and utility easements. <br /> <br />If this ordinance is adopted, the City will record the vacation so that deeds for the <br />affected properties will reflect the vacation. The City will also provide a certified copy of <br />the ordinance to the property owners who are affected by the vacation. <br /> <br />Recommendation: <br /> <br />City Staff recommends vacation of the drainage and utility easements described as <br />follows: <br /> <br />That part of the drainage and utility easement over, under, and across that part of Lot 1, <br />Block 2, Rum River Hills, lying within a 10-foot wide strip of land, the exterior <br />boundaries of which are the perimeter lot lines of said Lot 1, Block 2, Rum River Hills, <br />Anoka County, Minnesota. <br /> <br />-and- <br /> <br />That part of the drainage and utility easement over, under, and across that part of Outlot <br />C, Rum River Hills, lying within a 1 O-foot wide strip of land, the exterior boundaries of <br /> <br /> <br />
