I I I I I I I I I I I I I I I I I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #97-09- RESOLUTION GRANTING AN EXTENSION TO THE APPROVED PRELIMINARY PLAT OF REGENCY POND WHEREAS; Section 9.50.04 (Final Plat) of the Ramsey City Code states that the subdivider shall file copies of the final plat with the Zoning Officer within 12 months of preliminary plat approval, and thereafter, the Council may extend the period; and WHEREAS, Good Value Homes received preliminary plat approval of Regency Pond on March 12, 1996; and WHEREAS, Good Value Homes received final plat approval of the first phase of Regency Pond on July 9, 1996; and WHEREAS, Good Value Homes received final plat approval of the second phase of Regency Pond on May 27, 1997; and WHEREAS, the preliminary plat for the entirety of Regency Pond has officially expired and the third and final phase remains to be final platted; and WHEREAS, the City received a written request from Good Value Homes for an extension to the approved preliminary plat to facilitate the final phase of Regency Pond as presented to the City Council in March 1996. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council herein determines that the subdivider of Regency Pond has made a substantial investment in reasonable reliance on the approved preliminary plat. 2) That the City Council herein grants a 12-month extension to the approved preliminary plat for Regency Pond to facilitate the final development phase. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: '--/5
