CASE # ~ <br />REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT SOILS; <br />CASE OF GOOD VALUE HOMES <br /> By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On August 22, 1997, the City received an application from Good Value Homes, Inc. to grade and <br />export soils from the proposed plat of Apple Ridge in accordance with the grading plan approved <br />at the time of preliminary plat approval. Council granted preliminary plat approval of Apple <br />Ridge on June 24, 1997. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br /> <br />Notification: <br /> <br />Site location map <br />Approved grading plan under the preliminary plat <br />Draft Planning Commission public hearing and regular meeting minutes dated <br />September 2, 1997 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Public hearing notices were sent to properties in excess of the 350 feet radius required by State <br />law. <br /> <br />Observations: <br /> <br />The grading plan submitted for approval with the Apple Ridge preliminary plat will require <br />exporting approximately 120,000 yards of material from the site. City Code does not require a <br />special permit for grading operations associated with an approved plat, unless the operations <br />involve exporting soils from the site. One haul road access point is proposed onto T.H. #47. <br /> <br />The Applicant has indicated that the grading operation could take 24 months to complete. <br /> <br />The Planning Commission conducted a public hearing on September 2, 1997 and area residents <br />were looking for assurance that the tree preservation plan would be adhered to during grading <br />operations and all grading and public improvement activity would access the property from T.H. <br />#47 rather than froth the residential neighborhood to the west. Mr. John Peterson confirmed that <br />the activity would comply with the tree preservation plan and sole access will be from T.H. #47 <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommend approval of the permit <br /> <br /> <br />
