Fitzpatrick acting as primary <br />prosecutor. <br /> <br />The Firm shall be responsible for rendering all legal <br />services required in connection with the prosecution of <br />petty misdemeanor, misdemeanor and gross misdemeanor <br />offenses alleged to have been committed in the city. <br />Such responsibility shall include the following: <br /> <br />Preparation for and attendance at all arraignments <br />(if required), hearings, pretrials, trials, <br />sentencing and post sentence hearings involving <br />such offenses; <br /> <br />Preparation of formal complaints, motions, <br />pleadings and other documents required in <br />connection with the prosecution of such offenses; <br /> <br />Notification and/or subpoenaing of all witnesses <br />for court appearances or of continuances of such <br />court appearances. <br /> <br />'d. <br /> <br />Handling all necessary communications with <br />witnesses, police department personnel, court and <br />judicial personnel, defendants and defense <br />attorneys; and <br /> <br />Prosecution of an appeal to the Minnesota Court of <br />Appeals on any such offense brought by any <br />defendant on or behalf of the City. However, any <br />such appeals will be billed at the then prevailing <br />prosection hourly rate, and will not be subject to <br />the "not to exceed" provision described in <br />paragraph 5. below. <br /> <br /> <br />
