CASE # 7 PROPOSED ORDINANCE AMENDING SECTION 9.11.18 (GRADING, MINING AND FILLING PERMITS) OF THE RAMSEY CITY CODE By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik Background: Last month City Staff processed a grading and mining permit which involved excavations below an elevation six feet above the elevation of the water table. It was noted at the time that this is in direct conflict with City Code, and the basis for this restriction was unknown. The City Engineer has been in contact with DNR, the Anoka Soil and Water Conservation District, and the Board of Soil and Water Resources, and the basis of such a restriction in our zoning ordinance remains unknown. As a matter of fact, the Conservation District and the DNR encourage the construction of ponds under certain conditions. On September 23, I997, the above information was reported to City Council, and they directed City Staff to initiate action to amend City Code to allow for the construction of ponds under certain conditions. Observations: The proposed ordinance was presented to the Planning Commission on Tuesday, October 7, 1997. The Planning Commission reviewed it and recommended City Council adoption of same. However, the public hearing was inadvertently omitted from their agenda cover sheet and, therefore, no hearing occurred. Recommendation: City Staff is recommending introduction of the proposed ordinance at this time. The public hearing will be rescheduled for the October 21, 1997 special Planning Commission meeting and the ordinance will be brought back to the City Council for final adoption on October 28, 1997. Council Action: Motion to introduce the proposed ordinance to amend Chapter 9 of the City Code to allow for the construction of ponds under certain conditions.
