Billboards/Non-Conforming Uses <br /> <br />Page 2 <br /> <br />The second alternative would be to permit the affected signs to be <br />reconstructed and then amend the non-conforming use City Code <br />language in order to eliminate the argument presented by the <br />District Court Judge so that in the future we will be able to <br />confidently apply the non-conforming use restrictions. <br /> <br />Recommendation: <br /> <br />The second alternative referenced above <br />reconstruction in the appropriate cases. <br /> <br />and permit sign <br /> <br />Council Action: <br /> <br />Motion to: <br /> <br />Direct city staff to notify the affected sign companies <br />and/or landowners and advise them of the currant Court <br />interpretation of the City Code and that based on each <br />individual circumstance, the City will consider <br />permitting billboard reconstruction; and <br /> <br />Direct the City Attorney to develop an amendment to the <br />city Code's non-conforming use text in order to eliminate <br />the "market value" issue in the future. <br /> <br />Review Checklist: <br /> <br />Acting City Administrator <br />Zoning Administrator <br /> <br /> <br />
