City of Cottag~Grove Court File No. Ct-97-710 <br /> <br /> Universal Outdoor, Inc., ("Universal")is a corporation engaged in the <br />business of erecting, maintaining, and selling advertising space on outdoor <br />billboard signs, with its principal place of business in Minnesota at 1700 West <br />78th Streel~,'Richfield, Hennepin County, Minnesota. Defendant City of <br />Cottage Grove ("City")is a municipal corporation organized and existing <br />under the laws of the State of Minnesota. Universal and its predecessors has <br />leased an outdoor advertising sign location in the City on the west side of <br />Highway 61,400 feet southeast of Mile Post 127 since 1929. An outdoor <br />advertising sign has been continuously maintained at that location and was <br />completely remodeled in 1950 and 1971 and upgraded in 1991. The sign <br />complied with all applicable provisions of the city ordinances at the time it was <br /> <br />erected. <br /> <br /> The City passed Chapter 21 <br /> <br />of its ordinance effective April 6, 1983, <br /> <br />which relates to signs and billboards. The parties have agreed that the <br />ordinance should be made a part of the record with respect to the motions <br />pending before the Court. All off-premises advertising signs are prohibited <br /> <br /> <br />
