waives all fight to a public hearing and other statutory rights or City Charter rights <br />granted a property owner relating to special assessments, including the right to <br />appeal the special assessment for installation of the improvement described in this <br />paragraph. In addition, the DEVELOPER grants the fight to the CITY to enter <br />on each lot of the Plat in order to install the improvement described in this <br />paragraph, in the event it is necessary for the CITY to install this improvement <br />and specially assess the same. <br /> <br />III. PERMITS AND OCCUPANCY <br /> <br />14. <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the <br />Plat shall be issued until: (a) vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the Plat; (b) site plan approval is <br />granted by the CITY and any additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a Certificate of Survey, including <br />that information required by the CITY, been supplied to the City Building <br />Official; (d) a tree planting has been accomplished in accordance with Item #17 of <br />this Agreement; and (e) all the financial guarantees required by the CITY have <br />been satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />15. <br /> <br />Cash and Trail Development. The Plat is located in the Marble Park District. <br />Park dedication requirements shall be satisfied by a cash payment in the amount <br />of Forty Four Thousand Six Hundred Twenty Five Dollars and no cents <br />($44,625.00) (51 lots x $875.00 per lot). <br /> <br />V. TRANSPORTATION AND LANDSCAPING <br /> <br />16. <br /> <br />Park Trail Development Fee. The City Council has enacted a trail development <br />fee in the amount of One Hundred Dollars and no cents ($100.00) per lot. A <br />payment in the amount of Five Thousand One Hundred Dollars and no cents <br />($5,100.00) <br /> <br />17. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot <br />in the Plat prior to issuance of a Certificate of Occupancy. In accordance with <br />City Code and the policy established by the City of Ramsey Park and Recreation <br />Commission on June 10, 1993, the DEVELOPER is required to submit a <br />Landscape Plan for CITY approval that identifies existing tree growth within the <br />Plat that will be preserved during construction and new plantings.
