The following items are enclosed for your <br />information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site Plan and text <br />Letter of support <br />Draft Planning Commission meeting minutes dated October 7, 1997 <br />Proposed findings of fact <br />Proposed conditional Use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings and all properties <br />within 350 feet of the subject property are to be notified. Staff attempted to notify property <br />owners within 500 feet of the subject property. <br /> <br />Observations: <br /> <br />City Code establishes a threshold of 2.5 acres in order for residential property owners to <br />have the metal pole barn type accessory buildings. When Scott and Loft purchased their <br />property they were told that the property was 2.5 acres in size and qualified for a pole barn. <br />They were denied a building permit because their property is actually 1.7 acres in size. <br />The Jones did sue the realty company and the courts determined that they were wronged. <br />In any event, the Jones have applied for a conditional use permit for a metal accessory <br />building on less than 2.5 acres. The City has granted similar permits in the past for the <br />storage of personal equipment and vehicles when there is a sufficient mount of natural <br />screening existing on the property. <br /> <br />The Planning Commission conducted a public hearing regarding the request on October 7. <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommends approval of the request based on the <br />natural screening in place. Further, the Planning Commission recommends that the <br /> <br />building be designed to include soffit, eaves and facia. <br /> <br />/05 <br /> <br /> <br />
