In the event that the Anoka County Housing ancl Redevelopment Authorfty determines to authorize <br />a levy within the County pursumt to Minn. Stat. § 469.033, subdivision 6, such levy shall be subject to <br />the consent by resolution of the Anoka County Board of Commissioners. Further, the levy shall not be <br />effe~ve for any area of the County in which a municipal housing and redevelopment authority has been <br />established unless said municipality has adopted a resolution declaring that there is a need for the Anoka <br />County Housing and Redevelopment Authority to exercise its powers in the municlpaJity, The resolution <br />must be approved, pursuant to Minn. Stat. § 469.005, subd. 1, by the governing body of the municipality <br />and by any housing authority which has been established by the municipality. <br /> <br />2. An approved resolution, pursuant to Minn. Stat. § 469.005, subd. 1, declazing that there is need for <br />the Anoka County Housing Authority to exercise its powers in the municipality does not constftute or have <br />the effect of granting the Anoka County Housing and Redevelopment Authority the exclusive jurisdiction <br />for housing in the municipality described in Laws of 1978, Chapter 464, Section 1, subd. 2. <br /> <br />3. Pursuant to Laws of 1978, Chapter 464, Section 2, no project of the Anoka County Housing and <br />Redevelopment Authority shall be undertaken without the approval of the local governing body with <br />jurisdiction over all or any part of the area in which the proposed project will be located. <br /> <br />4. The approv,H of a local governing body allowing the Anoka County Housing md Redevelopment <br />Authority to undertake a housing and redevelopment project in that municipality does not.constitute or <br />have the effect of granting the Anoka County Housing and Redevelopment Authority the exclusive <br />jurisdiction for housing in a municipality described in Laws of 1978, Chapter 464, Section 1, subd. 2. <br /> <br />5. Approval of a resolution declaring the need for the Anoka County Housing and Redevelopment <br />Authority to exercise .its powers in a municipality may be rescinded by a municipality and any housing <br />authority which has been established in the municipality upon the adoption of a resolution withdrawing <br />the approvaJ. Approval for a specific housing and redevelopment project by a municipality may not be <br />rescinded, <br /> <br />6. In the event that the Anoka County Housing and Redevelopment Authority determines to undertake <br />a project in a municipality with an existing houSing authority and such project receives the necessary <br />local approvals, the Anoka County Housing and Redevelopment Authority sh~.~[all propose a joint powers <br />agreement to the. municipality which would provide for an agreement between the parties relating to the <br />project and provide for the continuation of the declaration of need for the Anoka County Housing And <br />Redevelopment Authority to exercise its powers in the municipality for an agreed period of time. <br /> <br />7. The Anoka County Housing and Redevelopment Authority shall not exercise the exclusive jurisdiction <br />for housing described in Laws of 1978, Section 1, subd. 2, unless requested to do so by the municipal <br />governing body and the municipal housing authority. <br /> <br />8. For the purposes of the Anoka County Housing and Redevelopment Authority Polities and <br />Procedures, a municipal economic development authority (EDA) shall be considered a municipal housing <br />and redevelopment authority as provided in state statutes unless limited by the local government <br />pursuant to Minn. Stat. § 469.092, subdivision 1(1), <br /> <br />9. The Anoka County Housing and Redevelopmerrt Authority shall not Undertake any economic <br />development projects. <br /> <br /> <br />
