Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97-09-280 adopting assessment for Improvement Project #97-16 (Bituminous <br />overlay Ford Brook Estates West of T.H. #47). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97-09-281 adopting assessment for Improvement Project #97-17 (Bituminous <br />overlay Barthel's Rum River Acres and Barthel's Rum River Acres 2nd Addition). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #3: Report from Canvassing Board <br /> <br />City Administrator Schroeder reported there were 9,134 registered voters in the City of Ramsey. <br />Twenty-six people registered on the day of the special election, bringing the total number up to <br />9,160 registered voters. A total of 595 people voted in the election with 396 voting yes and 199 <br />voting no. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to accept and <br />ratify the report received from the Canvassing Board. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #4: Impact of Charter Amendment <br /> <br />City Administrator Schroeder stated that developments after January 1, 1997, are affected by the <br />newly voted-in Charter amendment. As Council has discussed, there are many troubling aspects <br />to the language of the amendment. With the retroactive date of January' 1, that's almost nine <br />months prior to the election. During this nine-month period, several activities have occurred <br />which may be impacted by this retroactivity. An example of such concern is Alpine Estates. He <br />presented the following chronology: October 8, 1996 - Council authorized disposition of the <br />property; December 6, 1996 - The City received bids for the property; December 10, I996 - <br />Council authorized sale to KC Land Company; January 14, 1997 ~ Purchase agreement approved, <br />disposition ordinance adopted; April 8, 1997 - Preliminary plat approved; May 27, 1997 - Final <br />Plat/development agreement approved - rezoning introduced; June I 0, 1997 - Rezoning adopted; <br />June 24, 1997 - Charter petition received with 1/1/97 effective date; September 12, 1997 - <br />Property closing held - City completed sale of property; September 22, 1997 - Charter election. <br />Mr. Schroeder pointed out that the obvious concern is that a development process was completed <br />prior to this election which negates this development process and will have a financial impact <br />upon the parties to the process. He noted correspondence between Harstad Companies (the <br />purchaser/developer for Alpine) and the City Attorney regarding this issue. Basically, Harstad <br />has put the City on notice that this action will result in a damage claim.
