There is a sufficient amount of space available on the property to <br />do so and meet the 6 foot side yard setback requirement. However, at the time River's <br />Bend was platted, a 10 foot (versus the standard 5 foot) drainage and utility easement was <br />dedicated on the garage side of their property. No structure is allowed to encroach the <br />drainage and utility easement and therefore, their garage addition must adhere to a 10 foot <br />rather than a 6 foot setback. The extra 4 foot setback because of the drainage and utility <br />easement prohibits the addition of a stall width to the garage. <br /> <br />Observations: <br /> <br />The City Engineer indicates that at the' time River's Bend was platted, the utility plans <br />called for a storm sewer pipe to be installed between the Lof~on property and the next <br />parcel to the north. Thus, the final plat contained a total of 20 feet of drainage and utility <br />easement on the common property line, versus the standard 10 feet. The actual <br />construction plans show that the storm sewer pipe was installed several lots to the north <br />and therefore, the additional drainage and utility easement width acquired on the Lofton <br />property is not necessary. <br /> <br />Recommendation: <br /> <br />City Staffrecommends adoption of the proposed ordinance to vacate 5 feet of the 10 foot <br />drainage and utility easement on the Lofton property. <br /> <br />Council Action: <br /> <br />Motion to introduce ordinance #97- to vacate a portion of the drainage and utility <br />easement on Lot 45, Block 6, River's Bend. <br /> <br />Review Checklist: <br /> <br />City Engineer <br />City Attorney <br /> <br />CC: 11/10/97 <br /> <br />/o9 <br /> <br /> <br />
