The remainder of the
portion of the property is proposed to be rezoned to K-3 Urban residential to add to the existing
Urban Residential part of the site. On October 28, 1997, Council adopted findings of fact and
introduced ordinances to rezone the property as requested. The final adoption of the B-2 ordinance
is included on tonight's meeting agenda. The second reading of the R-3 Urban Residential rezoning
cannot be accomplished by City Council until the development moratorium has elapsed.

Both of the proposed lots meet the minimum size and width requirements for the commercial and
multi-family districts. The property is approximately 8 acres in size and they are proposing that the
commercial lot will be 3 acres and the multi-family parcel will be 5 acres in size.

The plat was reviewed by the Park Commission on September 11, 1997 and they recommended a
cash payment to satisfy park dedication requirements.

The continuance of the pedestrian path along the east side of T.H. #47 will be required along the
west boundary of Lot 1.

The final plat needs to be modified to dedicate right-of-access along T.H. #47 to the State, with the
exception of a temporary right-in only at the common boundary of Lot 1 and Outlot A. The
development agreement will require the developer to transfer the access rights for the temporary
right-in to the State at the time 153rd is signalized.
