The Plat sha:lt b~ developed pursuant to the final plat <br />for Rademacher Addition consisting of one sheet prepared by Hakanson Anderson <br />Associates, Inc. <br /> <br />3. Compliance with City Code. That the recitals above and the provisions of the <br />City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the <br />CITY as amended to date hereof, are incorporated herein by reference. <br /> <br />4. Access From Trunk Highway #47. The DEVELOPERS herein agree that <br />right-of-access along T.H. #47 shall be dedicated to the State of Minnesota, with the <br />exception of a temporary righMn only access on the common boundary of Lot 1 and <br />Outlot A. At such time as signalization improvements are installed at 153rd Avenue <br />N.W. and T.H. #47, the DEVELOPERS herein agree to transfer fight-of-access at Lot 1 <br />and Outlot A to the State. <br /> <br />5. Pedestrian/Bicvclist Path. The DEVELOPERS agree to construct, in <br />accordance with City standards, an eight (8) foot wide bituminous pedestrian/bicyclist <br />path, not to exceed 5% in grade, parallel to T.H. #47 along the entire west boundary of <br />Lot 1. The DEVELOPERS shall also provide approved turf 'establishment in <br />conjunction with the path construction within the subject Plat. This path shall be <br />constructed within a twenty (20) foot easement that has been deeded to the CITY in <br />recordable form. The construction plans for said path are subject to the prior approval of <br />the City Engineer. <br /> <br />6. Stormwater Management Fee. The CITY. has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Five Hundred Dollars per commercial <br />acre. The amount of Stormwater Management Fee due on Lot 1 is Eleven Thousand Four <br />Hundred Forty Five Dollars ($11,445.00) (3.27 acres x $3500/acre). The Stormwater <br />Management Fee will be utilized towards storm sewer improvements on 149th Avenue <br />N.W. <br /> <br /> II. <br />BUILDING PERMITS AND CERTIFICATE OF OCCUPANCY <br /> <br />7. Requirements for Building Permits. No building permit for any lot in the Plat <br />shall be issued until (a) the City is provided with an easement, in recordable form, for a <br />pedestrian/bicyclist path purposes along the westerly 2{J feet of Lot 1; (b) site plan <br />approval is granted by the CITY and any expense incurred in giving site plan approval <br />has been reimbursed to the CITY; (c) a Certificate of Survey including that information <br />required by the CITY has been supplied to the Building Official.
