I I I I i I I I I CASE NO. YOUTH ACCESS TO TOBACCO ORDINANCE By: Dave Gustafson, Chief of Police and William K. Goodrich, city Attorney Background: The 1997 legislature passed the Minnesota Youth Access to Tobacco law, (the "Act") effective August 1, 1997. The Act requires licensing of all retailers who sell tobacco or tobacco products. The city is required to adopt a licensing ordinance after August 1, 1997. Most cities will be adopting these ordinances in early 1998. The City ordinance needs to comply with at least the minimum standards set by the State law. If the City does not act on such a licensing ordinance, the county is obligated to do so. In order to orientate and inform you on this subject, enclosed is information which has been prepared by the Minnesota League of Cities. Also enclosed for your review is a League model ordinance. Please note the "options" contained in various sections of the model ordinance. We will be asking directions at the Council meeting on October 24, 1997 as to which options to include in the City's final ordinance. Once preliminary proposed language has been agreed upon, each tobacco licensee must be given 30 days prior notice of the meeting at which final action on the proposed ordinance will be considered. In order to have the ordinance adopted in January, 1998, Staff has sent letters to the affected licensees advising them that the Council will consider adoption of the ordinance at the Council's December 9, 1997 meeting. Council Action: Review the enclosed information and direct questions to City Attorney. Chief Gustafson will not be at this meeting, but will be at the November 25 meeting for additional questions and to discuss policy decision. Review Checklist: Acting City Administrator
