I <br /> <br />I <br />I <br />I <br />i <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />CASE NO. <br /> <br />YOUTH ACCESS TO TOBACCO ORDINANCE <br /> <br />By: <br /> <br />Dave Gustafson, Chief of Police and <br />William K. Goodrich, city Attorney <br /> <br />Background: <br /> <br />The 1997 legislature passed the Minnesota Youth Access to Tobacco <br />law, (the "Act") effective August 1, 1997. The Act requires <br />licensing of all retailers who sell tobacco or tobacco products. <br /> <br />The city is required to adopt a licensing ordinance after August 1, <br />1997. Most cities will be adopting these ordinances in early 1998. <br />The City ordinance needs to comply with at least the minimum <br />standards set by the State law. If the City does not act on such <br />a licensing ordinance, the county is obligated to do so. <br /> <br />In order to orientate and inform you on this subject, enclosed is <br />information which has been prepared by the Minnesota League of <br />Cities. Also enclosed for your review is a League model ordinance. <br />Please note the "options" contained in various sections of the <br />model ordinance. We will be asking directions at the Council <br />meeting on October 24, 1997 as to which options to include in the <br />City's final ordinance. <br /> <br />Once preliminary proposed language has been agreed upon, each <br />tobacco licensee must be given 30 days prior notice of the meeting <br />at which final action on the proposed ordinance will be considered. <br />In order to have the ordinance adopted in January, 1998, Staff has <br />sent letters to the affected licensees advising them that the <br />Council will consider adoption of the ordinance at the Council's <br />December 9, 1997 meeting. <br /> <br />Council Action: <br /> <br />Review the enclosed information and direct questions to City <br />Attorney. Chief Gustafson will not be at this meeting, but will be <br />at the November 25 meeting for additional questions and to discuss <br />policy decision. <br /> <br />Review Checklist: <br /> <br />Acting City Administrator <br /> <br /> <br />
