The previous state law regulating <br />vending machine sales (Minn. Stat. sect. 325E.075) was repealed. <br /> <br />Prohibit self-service sales. In 1996, the FDA enacted measures to reduce the <br />sale of tobacco to youth. These measures will take effect at different times. <br />(See Chapter.7 of this manual.) Included was a ban on self-service sales. <br />The FDA guidelines interpret serf-service sales to mean any transaction <br />where there is not an actual physical exchange of the tobacco between the <br />seller and the buyer. Under the new Minnesota tobacco law, self-service <br />sale of individual cigarette packages or containers of smokeless tobacco is <br />prohibited until such time as these FDA regulations take effect. When the <br />FDA regulations become effective, all serf-service sales of cigarettes and <br />smokeless tobacco is prohibited. An exception to the ban on self-service <br />sales is made for establishments that are off limits to minors at all times, <br />and which derive 90% or more of their revenues from selling tobacco and <br />tobacco products. <br /> <br />Licensing fees <br /> <br /> The new youth access law authorizes the governing body to establish <br />licensing fees that will cover the cost of administrating and enforcing the <br />above provisions. <br /> <br />Substance disclosure <br /> <br /> The new state law requires manufacturers of: any tobacco products sold <br />in Minnesota to provide the State Health Commissioner with a report <br />disclosing the presence of a detectable level (either in the product's burned or <br />unburned state) of ammoriia, or of' any compound of ammonia, ~rsenic, <br />cadmium, formaldehyde, and lead for each brand of tobacco product sold in <br />the state. Local units of governments can request 'a 'copy of the report to assist <br />with the enforcement of local ordinances. <br /> <br /> <br />
