I <br /> I <br /> I <br />'1 <br /> <br />I <br />I <br /> <br />i <br /> I <br /> I <br /> I <br /> <br /> SCHEDULE PUBLIC HEARING FOR CONSIDERATION <br />OF ON-SALE LIQUOR LICENSE ALLEGED VIOLATION <br /> <br />By: <br /> <br />Dave Gustafson, Police Chief and <br />William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />The City alleges that on October 5, 1997 at approximately 4:00 p.m. <br />the Lighthouse Grille & Bar, 6937 Highway 10 NW illegally sold or <br />furnished an alcoholic beverage to a person under twenty-one (21) <br />years of age. Selling, furnishing or delivering an alcoholic <br />beverage to a person under 21 years of age is both a violation of <br />State law and City Code Sections 7.52.12g, 7.52.15 and 7.52.16. <br /> <br />City Code provides that the City Council may impose appropriate <br />sanctions against an "on-sale" licensee for the violation of any <br />section of the City Code or State law. Before said action may be <br />taken, the licensee must be given a public hearing at which city <br />Staff shall present testimony and evidence of the alleged violation <br />and the licensee may defend its actions. Based on the evidence <br />presented to it, the City Council acting as trier of fact, shall <br />then determine if a violation has occurred, and if so, what is the <br />appropriate sanction. Pursuant to State law, if a violation is <br />found, the City may suspend for up to 60 days, revoke, or impose a <br />civil penalty not to exceed $2,000.00 for each violation, or impose <br />any combination of these sanctions. <br /> <br />The public hearing referenced above must be preceded by 10 days <br />written notice to the licensee advising of the time, date, place <br />and issues involved. <br /> <br />Recommendation: <br /> <br />Staff requests that a public hearing on this issue be scheduled for <br />November 24, 1997 at 6:00 p.m. and that written notice be given to <br />the licensee of the hearing, pursuant to the city Code/State <br />statute requirements. <br /> <br />Council Action: <br /> <br />Motion to schedule a public hearing at 6:00 p.m. on November 24, <br />1997 in the Ramsey City Council Chambers for the purpose of <br />determining if the Lighthouse Grille & :Bar has violated City Code <br />and State statute by selling or furnishing alcoholic beverages to <br />a person under 21 years of age, and further that the City Staff <br />shall give the required written notice of the public hearing to the <br />licensee, which notice shall contain those items as required by <br />law. <br /> <br />Review Checklist: <br /> <br />Acting City Administrator <br /> <br />/5 <br /> <br /> <br />
