CASE # <br />ADOPT ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT; <br />CASE OF CINDY LOFTON <br />By: Zoning Administrator Sylvia Frolik <br />Background: <br />On November 10, 1997, the City Council introduced an ordinance to vacate a portion of <br />the drainage and utility easement at 14301 Waco Street N.W. There was an extra wide <br />utility easement dedicated on this parcel to facilitate a storm sewer pipe installation that <br />ended up being installed further north in the River's Bend plat. . <br />Now the Lofton's want to add a stall to their attached garage and they cannot meet <br />setback requirements unless the excess utility easement is vacated. <br />Observations: <br />The ordinance is eligible for adoption at this time. <br />Recommendation: <br />City Staff recommends adoption of the proposed ordinance to vacate 5 feet of the 10 foot <br />drainage and utility easement on the Lofton property. <br />Council Action: <br />Motion to adopt Ordinance #97- "I to vacate a portion of the drainage and utility <br />easement on Lot 45, Block 6, River's Bend. <br />Review Checklist: <br />City Attorney <br />CC: 11/25/97 <br />
