I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> I <br />'1 <br /> I <br />,I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE # / <br /> <br />REQUEST FOR VACATION OF EASEMENTS; <br />CASE OF CHARLES CHRISTIAN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Approximately one year ago, the City Council approved Mr. Charles Christian's request to replat <br />his 2 commercial lots at 153rd Avenue and Highway #10 into 4 lots. To facilitate error-free <br />rededication of all necessary and standard drainage and utility easements on the final plat in <br />accordance with existing underground utilities and with the new property line locations, the <br />vacation of all pre-existing easements was required and requested. The public hearing to vacate <br />the underlying easements was held and Mr. Christian announced that he lost the buyer for one of <br />the lots and he would not be recording the plat until there was a buyer. Mr. Goodrich <br />recommended that the underlying easements not be vacated until the replat is a certainty. <br />Therefore, Council denied the request to vacate the easements at that time. The following items <br />are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying lots and easements and proposed lots and easements <br />proposed ordinance ' '~ "'" <br /> <br />Observations: <br /> <br />Mr. Christian now has a buyer for the lot occupied by the existing building and he is preparing to <br />record the plat. We must now proceed again with the public hearing and ordinance adoption to <br />· vacate the underlying easements. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the enclosed ordinance to vacate pre-existing easements. <br /> Council Action: <br /> <br />Motion to: <br />Introduce Ordinance #97- to vacate all drainage and utility easements within the <br />boundaries of the plat of Ramsey Commercial Park. <br /> <br />Review Checklist: <br /> <br />CC: <br /> <br />City Engineer <br />City Attorney <br /> <br />12/09/97 <br /> <br /> <br />
