CASE <br /> <br /> REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br /> NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE; <br /> CASE OF PETER AND LINDA MAYER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Peter Mayer is requesting a variance to construct an accessory <br />garage nearer the front property line than the principal structure at 7190 175th Avenue NW. The <br />parcel is approximately 10 acres in size, and the house is located approximately 167 feet from the <br />front property line. They are proposing to construct a garage which will be approximately 40 <br />feet from the front property line. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />Properties within 500 feet of the Mayer property were notified of the public heating. <br /> <br />Observations: <br /> <br />The site plan submitted reveals that there are declines in topography, mature tree growth, septic <br />system and drainfield locations, and wetlands that prevent locating an accessory structure in the <br />side or rear yard. The applicants essentially created a 167 foot front yard setback when they sited <br />the house on the lot. However, due to substandard soils, the selected site was the only reasonable <br />building pad on the property. An additional factor to be considered is the structure setback from <br />thoroughfares which is 60 feet from the tight-of-way centerline plus the local applicable setback, <br />which in this case is 40 feet. Therefore, the accessory structure should maintain a 100-foot <br />setback from the County Road #63 centerline, and it appears the proposed locat-ion for the <br />accessory structure will not meet this requirement. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends approval of the request for a variance contingent on meeting the <br />thoroughfare setback. <br /> <br /> <br />
