CASE <br /> <br />REVIEW PROPOSED CHARTER AMENDMENT <br />By: Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />At the June 24, 1997 meeting, Council was presented with a petition for a proposed Charter amendment. The <br />amendment reads as follows: <br /> <br />Section 14.2 Community Development Standards <br />Expansion of the MUSA enables residential development at a significantly higher density. The following <br />community development standards have been written to mitigate the impact high density residential <br />development may have on existing lower density neighborhoods thereby protecting their value and quality of <br />life. These standards apply to all residential development receiving final plat approval after January, 1997. <br /> <br />14.2.1 Residential Real Property Density <br />All residential lots platted within the MUSA after January 1, 1997, ("Subject Property") shall provide <br />that the number of residential platted lots per acre ("Density") of all residential lots platted within the <br />Subject Property that share a common border(s) with residential lots platted prior to the Subject Property <br />("Existing Property") shall not exceed the lesser of (i) the Density of the Existing Property immediately <br />adjoining the Subject Property at their respective common border(s) or (ii) one (1) residential platted lot <br />for every one (1) acre of Subject Property. And shall further provide that all residential lots platted <br />within the Subject Property that are within 1,000 feet of a common border(s) with Existing Property <br />shall be subject to a graduated density plan approved by the City. <br /> <br />14.2.2 Traffic Generation Analysis <br />Residential real property platted within the MUSA after January 1, 1997, shall be subject to a traffic <br />generation analysis which shall be provided by the developer of the Subject Property. The city shall <br />review this analysis for the purpose of making a traffic impact determination. In the event the city's <br />traffic impact determination establishes that the proposed development of the Subject Property will <br />significantly increase the existing traffic flow through Existing Property which is destined for the county <br />and/or Minnesota highway system the city of Ramsey shall limit the platted Density of the Subject <br />Property to that of the adjacent Existing Property. <br /> <br />City staff is in the process of verifying the signatures of the petition. City Attorney Goodrich will have received <br />a statement as to whether or not this proposed amendment is deemed constitutional.
