Then based on the developer's data, the City must <br />determine whether the development "significantly increase[s]" the existing traffic flow <br />through existing subdivisi,ons. There are no criteria for establishing when a significant <br />increase occurs, nor is there a direction to the City to establish the criteria by ordinance. <br /> <br />If the City is unable to deal with the rezoning by charter amendment, it should consider its <br />options. First, it could submit the amendment to a vote, and if adopted could join in a lawsuit <br />to seek its invalidation. Second, it could, after closer analysis, reject the petition and not submit <br />it for a vote. In this case, the proponentq would.have to sue the City.
