IV, § 36. <br /> <br /> Question No, 1 <br /> <br /> Whether the proposed amendment numbered 11 submitted to the Mayor <br />of Minneapolis by the City Charter Commission on July 30, 1948, and by him <br />on the same date to the city council may'be voted upon at the general state <br />election on November'2 next or whether the 90 day provision of the statute <br />· requires that it must be submitted prior to that date or some time prior to <br />October 28. <br /> <br /> Opinion No. 1 <br /> <br /> Unless otherwise noted, section references herein made are to those in <br />Minnesota Statutes Annotated. <br /> <br /> Section 410.12 provides that: <br /> <br /> "Amendments shall be submitted as in the case of the original <br /> charter * * * " <br /> <br /> The State Constitution, Article IV, Section 36, provides for the accep- <br />tance of the proposed amendment "by three-fifths of the qualified voters of <br />such city or village voting at the next election and not otherwise; * * * ." <br /> <br /> Section 410.10 contains the provisions with reference to the submission <br />to the voters of the original charter. A§ above stated, Section 410.12 <br />requires charter amendments to be submitted as in the case of the original <br />charter. Therefore, the provisions of Section 410.10 apply to the submission <br />bf amendments as well as to the original charter. <br /> <br /> The material provisions in Section 410.10 read as follows: <br /> <br /> "Upon delivery of such draft, the council or other governing body <br /> of the city or village shall cause the proposed charter to be submitted <br /> at the next general election thereafter occurring in the city or village <br /> within six months after the delivery of such draft, and if ~here is no <br /> <br /> <br />
