"" ....n o ..., ,, o /i2/Z~

preference ~,~ any. ins%~.nce b3'~ns~' ~-~n.~- a cross
tike ~un~r~ If eny chaucer ~o sub~ttod be rejected.
the bo.~ ~y propose otkers from time to time until
one ts adopted."

Section ~!0.t2, ~,~nnesota Statutes 19~.!~ bo~m~ Section
1286, ~,~son's Statutes 1927, reads as fo!lo%~s:

"The board' of freeholders may oropose a~endments to
such ch-fret, and shall do so cpo5 the petition of five
per certs of the voters of the city, set~ing forth in sub-
stance the amendment desired. Amendments shall be submitted
as in the case of the original charter and the proposal shall
be puklished for at least 30 days in no~ exceeding tbme~ news-
papers of general-circulation in such city. The form of hal-.
lo~ and mode of voting shall be s~m~lar to those used upon
the adoption of such charter, the general'nature of each
amendment being briefly indicated. If three-fifths of those
la~fully vo~ing at such election shall declare in favor of
amy amendment so proposed, the same shall be certified~ de-
posited, and recorded, and shall take affect, as in the case
of the origins3, charter~ provided that, if iZ be proposed
tha~ any amendment shall ~ake effect at a specified time~
it shall take effect as proposed."

It is my opinion that the correct construction of these
provisions is tha~ amendments to the citT charter may ~e propel?sd
by the charter commissicn on its o~m initiative~ Such-amendments
must also be submitted ~o the voters when petitioned for by five
per cent of the voters.

QUESTION 2:

Ca~ an amendment to the chmrter be submi~bted for ratifica-
tion on the same day as the statewide primary ~lectlon)~ or must a
separate and distinct election be called? ~

OPINION:

A separate and distinct election must be called, but I £ir~d
no objection to holding it on the same day as the sta~ew~de primary
election, so that the election officials' of ~]~ primary elecroi~n ,~
also serve as election officials of the s'oecio! election.~

I$ is a special election e-~on tho~i.%h it is held c-n th.o
same day am the general ele,.'~'~
