-9-

CHARTER ELECTION BALLOT

Shall the proposed new
charter be adopted?

Yes

No

Shall the alternative section
35A be adopted in lieu of ~section
'35 relating to the debt limit of
the city?
Yes

No

.Majority required for a~option. (M.S.A. 410.10.) The Constitution provides
that a proposed charter can be adopted by such majority as the legislature
may prescribe. The majority needed for adoption of a new charter, as now
prescribed by law is 51 percent of those v6ting on the ques%~on at the election,
except 55% is required to remove or amend charter provisions establishing
liquor patrol limits.

Certification of charter. (M.S.A. 410.11.) If the charter is adopted, the
city clerk must file copies in'the office of the Secretary.of State, the office
of the Register of Deeds, and his own office. Each copy must be 'accompanied
by a certificate attesting to its accuracy and giving the date oD the election
and the vote by which the charter was adopted. Two or more to the League of Minnesota Municipalities, 300
Hanover Building, 480 Cedar Street, St. Paul, ~ 55101, one to the Minnesota
Historical Society, St..Paul; one to the Public Affairs Library, 365 Blegen Hall,
University o£ Minnesota,.Minneapolis, 55455; one to the State Library, Capitol,

· St. Paul; one or more to the local city library; one to the clerk of the district
court for the county. Not only will these copies be frequently referred to in
~d~ese various places~, but the city will gain. a good name from a fairly liberal
policy in the distribution of its charter. The League can profitably use
several copies to' send on library loan to other Minnesota charter commissions
'considering new charters.

Charter in effect. Succession. (M.S.A. 410.11.) Assuming that the certifi-
cates mentioned above have been deposited, the new charter will take effect at the
end of thirty days from the date of the election or at such other time as is
fixed in the charter. It supersedes the previous charter of the city, if any,
the courts are required to-take judicial notice of it, and the officials~elected
and appointed under it may take o~er the control of the city's records, money,
and proPerty at any time specified therein. The charter may provide that in''
