live in the area. I consulted with a couple of attorneys and it was determined the language was
legal. He (Hendriksen) then found four individuals to assist with the petition. Then the City failed
to complete the project as scheduled. If done so, the people on 151st would not have received the
protection of that amendment. The Haubrich's were protected from the $37,000 assessment. The
right things happen for the wrong reasons. The people on 151st did participate in the circulation
after the first of the year and also to educate voters. You need to be fair if you are representing the
City. You need to have an unbiased, middle-of-the-road report.

Jim Green, 5850 - 151st Lane NW, Ramsey, stated he does live on 151st Lane. This was done
legally. The City ordered the project for assessment as per the ordinance at that time. After the
first of the year, you (to Hendriksen) slipped in the Charter amendment, for one reason - so three
people would have to pay. The City made a good business decision, we cannot control Mother
Nature. They made a right decision to wait. The project was done 99% other than restoration.
We could have dirt streets and have City sewer and water.

Terry Hendriksen said that Mr. Green had petitioned for the project and received it.

APPROVE AGENDA

Councilmember Beyer asked to have Item #5 on the Consent Agenda moved to the regular agenda
as Case #6.

Motion by Councilmember Peterson and seconded by Councilmember Beahen to approve the
agenda as amended.

Motion carried.
