Section 9.15.05 (a). The from requests that "one mile search radius" be changed to <br />"one-quarter (1/4) mile search radius". Staff believes "one mile search radius" should <br />remain. <br /> <br /> Section 9.15.05 (a) (1). The fzrm requests that the phrase "qualified and licensed <br />professional engineer" be changed to "qualified engineer" in this section and all subsequent <br />sections in which the phrase appears. Staff believes "qualified and licensed professional <br />engineer" should remain. <br /> <br /> Section 9.15.05 (a) (2). The firm requests that the phrase "qualified and licensed <br />professional engineer" be changed to "qualified radio frequency engineer". Staff believes <br />that "radio frequency" can be added but that "and licensed professional" should be retained. <br /> <br /> The firm requests that a section be added to Section 9.15.05 (a) that reads: "In spite <br />of its best efforts, within 60 days, the applicant was unable to obtain approval to co-locate <br />on an existing or approved tower or building." Staff would like further explanation from <br />the firm if this section is to be added. <br /> <br /> Section 9.15.05 (a) (5). The firm requests that the phrase "Other unforeseen <br />reasons that make it infeasible" be replaced with "Other reasons that make it impracticable". <br />Staff is not clear as to why the firm feels that this change is necessary. <br /> <br /> Section 9.15.05 (b). The firm requests that in order to require a tower to be <br />constructed in a way that will be able to accommodate one additional user, the minimum <br />height of a tower should be changed from 60 to 75 feet. Staff is comfortable with this <br />suggestion. <br /> <br /> Section 9.15.07 (a). The firm requests that the phrase "camouflaging architectural <br />treatment" be changed to "design". Staff is comfortable with this suggestion. <br /> <br /> Section 9.15.07 (b). The f~rrn suggests that "radio frequency (RF)" be eliminated <br />and that the phrase "the number of co-locations warrants this consideration" be changed to <br />"the number of potential co-locations warrants an alternate design." Staff believes that <br />"radio frequency (RF)" should remain, but is comfortable with the latter request. <br /> <br /> Section 9.15.07 (c). The firm suggests that this section be eliminated. Staff <br />believes it should remain. <br /> <br /> Section 9.15.08 (b). The firm requests that in non-residential districts, towers be <br />allowed to encroach into the side or rear setbacks if the side or rear property line abuts <br />another non-residential zoned property, rather than only allowing encroachment into rear <br />setbacks and only in industrially zoned areas. Staff is comfortable with this request. <br /> <br /> The firm requests that a section be added to Section 9.15.08 that reads: "A lesser <br />setback distance may be used if a qualified engineer specifies in writing that the collapse of <br />the proposed tower will occur within a lesser distance." Staff will be comfortable with this <br />request if "qualified engineer" is changed to "qualified and licensed professional engineer." <br /> <br /> The firm requests that a section be added to Section 9.15.08 that reads: "The <br />setback shall be measured between the base of the tower located nearest the property line <br />and the actual property line." Staff is comfortable with this request. <br /> <br /> <br />
