· CASE By: REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT SOILS; CASE OF ERIC THOMSEN City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik Background: On January 14, 1997, the City received an application from Eric Thomsen to grade and export soils from an area generally located west of T.H. #47 and south of County Road #63, at about Vanadium Street N.W. The subject property consists of 9 acres. The following items are enclosed for your information: a) b) c) d) Site location map Grading Plan and accompanying letter dated 1/14/97 Proposed findings of fact Proposed conditional use permit Notification: ConditionaJ Use Permits are required to be subjected to public hearings with all properties within 350 feet being notified of the public hearing. In this case, Staff attempted to notify all property owners within 500 feet of the subject property. The Anoka County Highway Department was also notified of the conditional use permit application. Observations: The Grading Plan requests approval for the removal of 200,000 cubic yards of materials from an area of approximately 9 acres. The application requests the duration of.the permit to be for a 5 yerar period. Silt fence is proposed to be placed along the wetland adjacent to Trott Brook. No grading will occur in the wetland. Twenty-one coniferous trees .and 7 hardwood trees will be removed to facilitate the grading according to the plan. Recommendation: City Staff recommends approval of the permit contingent upon the following conditions: 1) The period of the permit be limited to two years. 2) A like number of trees be planted to replace the removed trees. The trees should be a minimum of 1-1/.2 inches in diameter and be of simillar species to those removed. 3) The Granding Plan be modified to show the extent of the excavation phasing and the topsoil stockpile area. 4) That the clean fill requested for importation be limited to topsoil for restoration purposes.
