· CASE <br /> <br />By: <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT TO <br /> GRADE AND EXPORT SOILS; CASE OF ERIC THOMSEN <br />City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On January 14, 1997, the City received an application from Eric Thomsen to grade and export soils <br />from an area generally located west of T.H. #47 and south of County Road #63, at about <br />Vanadium Street N.W. The subject property consists of 9 acres. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Grading Plan and accompanying letter dated 1/14/97 <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />ConditionaJ Use Permits are required to be subjected to public hearings with all properties within <br />350 feet being notified of the public hearing. In this case, Staff attempted to notify all property <br />owners within 500 feet of the subject property. The Anoka County Highway Department was also <br />notified of the conditional use permit application. <br /> <br />Observations: <br /> <br />The Grading Plan requests approval for the removal of 200,000 cubic yards of materials from an <br />area of approximately 9 acres. The application requests the duration of.the permit to be for a 5 <br />yerar period. Silt fence is proposed to be placed along the wetland adjacent to Trott Brook. No <br />grading will occur in the wetland. Twenty-one coniferous trees .and 7 hardwood trees will be <br />removed to facilitate the grading according to the plan. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the permit contingent upon the following conditions: <br /> <br />1) The period of the permit be limited to two years. <br /> <br />2) <br /> <br />A like number of trees be planted to replace the removed trees. The trees should be <br />a minimum of 1-1/.2 inches in diameter and be of simillar species to those removed. <br /> <br />3) <br /> <br />The Granding Plan be modified to show the extent of the excavation phasing and <br />the topsoil stockpile area. <br /> <br />4) <br /> <br />That the clean fill requested for importation be limited to topsoil for restoration <br />purposes. <br /> <br /> <br />
