Zoning Administrator Frolik stated that it would not be considered lawfully non-conforming because a conditional use permit was issued. Chairperson Bawden stated that he would support Staffissuing permits for the tower if they comply with the ordinance. He agreed that the code must be written clearly so it can be easily read and interpreted. Commissioner Deemer asked if the site plan process requires a public hearing. He would like antenna tower applications to include a site plan process. Zoning Administrator Frolik stated that a site plan review does not include a public hearing and would require seven weeks from the date of application for a decision. Commissioner Deemer stated that he would like to be sure the process requires a public posting at the Planning Commission meeting or City Council meeting before it goes forward. Chairperson Bawden asked if there would be concern if this matter were brought back to the next meeting after the ordinance language has been amended and clarified. Mr. Alexander offered to assist in any way possible. Motion by Commissioner Holland and seconded by Commissioner Deemer to table action on the proposed Ordinance to Establish Regulations for Towers and Antennas until the February meeting in order to allow Stafftime to meet with Mr. Alexander and clarify the ordinance language. Discussion: Commissioner Deemer referred to page 16, Section 9.15.05 (a)(4) and questioned the use of the word "infeasible." Also in Section 9.15.08 (c)(2), he would like to see reference to sides of public streets stipulate the county side and not the local side. Chairperson Bawden asked Commissioners to review the ordinance in light of this meeting's discussion and come to the next meeting prepared with suggested changes. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, LaDue, Terry, Thorud. Voting No: None. Absent: None. Case #4: Review City Code Chapter 9, Zoning and Subdivision Zoning Administrator Frolik suggested that the Commission may wish to set up a workshop to work on updating zoning regulations, which should be reviewed page by page. Cha/rperson Bawden stated that he would like to see a subcommittee work on this project and make recommendations to the whole Commission. Commissioners Deemer and Jensen volunteered to work on the subcommittee.
