CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A SEASONAL, OUTDOOR, <br />RECREATIONAL FACILITY; CASE OF HOLM'S SUPER BOWL, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City has received an application for a conditional use permit from Super Bowl to establish <br />four volley ball courts and an outdoor bar area on the west side of the Super Bowl structure <br />located at 6740 Highway #10 NW. <br /> <br />Observations: <br /> <br />The applicants are proposing to eliminate the two existing volley ball courts on the east side of <br />the building and relocate this activity to the west side and increase the number of courts from two <br />to four. The operation of the existing volley ball courts on the east side of the structure were <br />permitted to occur without benefit of a conditional use permit as an extension of the indoor <br />commercial recreational use. The City has, on occasion, received complaints regarding <br />trespassing on to adjacent residential parcels and noise as a result of the volley ball activities. <br />Therefore, when the applicant approached the City regarding relocating the courts to the west <br />side and increasing the number of courts, it was determined by City staff that a conditional use <br />permit would be appropriate. <br /> <br />The applicant has stated that the establishment of these courts on the west side of the building <br />will not deplete the amount of existing off-street parking spaces on the site. <br /> <br />The surrounding parcels to the east, west, and north are zoned commercial and the parcel <br />immediately adjacent on the southwest side of the subject property is currently going through a <br />rezoning process from commercial to single family residential. The applicant has submitted a <br />site plan that proposes to encompass the entire volley ball court area in chain link fence. This <br />chain link fence would be established approximately one foot in from the common property line <br />with the adjacent parcel to the southwest. The actual courts themselves would then maintain a <br />40-foot separation from the adjacent parcel on the southwest. <br /> <br />The applicant has also proposed to plant some trees along Ebony Street. City Code does not <br />require screening in this area but it does require a 20-foot wide landscaped area along public <br />streets. The width of this landscape area is not noted on this site plan. The site plan also <br />proposes to establish trees between courts one and three and two and four. City staff would <br />recommend that although there is already a substantial tree cover between the subject property <br />and the adjacent parcel on the southwest, that additional coniferous trees be established along <br />this common property line and the southwest comer of the property to intensify the effect of the <br />screening from the residential neighborhood to the south. <br /> <br /> <br />
