WHEREAS, the DEVELOPER desires to construct the Stage I and Stage II <br />improvements, except for those Stage II Improvements constructed by the CITY. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />City Code Compliance. That the DEVELOPER will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br />Conformance with Plan. The Plat. shall be developed pursuant to the final <br />plat consisting of two (2) sheets, prepared by Bradley J. Canaday Surveying. <br /> <br />Incornoration of All City Code Reauirements. That the recitals above and <br />the provisions of the City Charter, Subclivision Code, Zoning Code and Public <br />Improvement Code of the CITY as amended to date hereof, are incorporated herein <br />by reference. <br /> <br />Stage I Improvements Required. The DEVELOPER agrees to construct the <br />required Stage I Improvements according to the terms and conditions of this <br />contract and in accordance with DEVELOPERS' plans submitted to the CITY. <br />Said plans shall be in general conformance with the Final Grading Plan prepared by <br />Ulteig Engineers, Inc., dated November 20, 1995. <br /> <br />It is herein agreed that the CITY approves deviating from the street grid system <br />and that the cul-de-sac to be constructed shall be named Andrie Court N.W. <br />Further, the CITY herein agrees to waive the six (600) hundred foot maximum <br />dead end length and allow Andrie Court N.W. to be constructed at approximately <br />one thousand one hundred (I,100) feet in length provided that the radius of the cul- <br />de-sac bubble is sufficiently large enough, in the opinion of the City Engineer, to <br />facilitate navel in and out by most public and emergency vehicles in one movement <br />and that the DEVELOPER accepts responsibility for constructing and maintaining <br />a landscaped center island in the cul-de-sac bubble to increase runoff and snow <br />storage area and break up the spance of blacktop. <br /> <br />Stormwater Drainage. The DEVELOPER has proposed a drainage plan dated <br />November 20, 1995 prepared by Gerald Floden, P.E., for this plat. This drainage <br />plan is acceptable to the CITY and if implemented, the CITY agrees to contribute <br />the cost difference in upsi~ing the pipe from 15 inches to the actual pipe size u~ <br />to convey drainage from 153rd Avenue N.W. to the sedimentation pond. If the <br />DEVELOPER elects the altemate drainage plan illustrated in Exhibit A attached to <br />this agreement, the storm sewer ' proposed from Andrie Court N.W. will not be <br />necessary. In addition, the CITY will contribute the costs associated with the <br />restoration of tuff and bituminous pavement associated with the installation of storm <br />sewer in Andrie Street N.W. If this alternate drainage plan is selected, the CITY <br />will contribute the cost difference in upsizing the pipe from 15 inches to the actual <br />size pipe utilized to convey drainage from 153rd Avenue N.W. to the sedimentation <br />pond. <br /> <br />6.
